The following Privacy and Data Protection Principles establish the manner in which Energías Sustentables Cotell, S.A. de C.V. will collect, use, store, share, transmit, delete, or otherwise process your personal data. Personal data is understood as any information relating to an identified or identifiable natural person (Art. 3 F.V L.F.P.D.P.P.P.). The personal data protection standard established in these Principles will be applied by Energías Sustentables Cotell, S.A. de C.V. at the local level, providing adequate and consistent protection for the processing of your personal data. Processing of your personal data is understood as the obtaining, use, disclosure, or storage of personal data by any means (Art. 3 F. XVIII L.F.P.D.P.P.P.). Use includes any action of access, management, use, transfer, or disposition of personal data.
In these Principles, the terms "you" and "your" refer to any natural person who is a customer or employee of Energías Sustentables Cotell, S.A. de C.V., and to any other natural person whose personal data we process; and "we", "our", and "Energías Sustentables Cotell, S.A. de C.V." refer to Energías Sustentables Cotell, S.A. de C.V.

Collection: We will only collect the personal data that is necessary, which may include name, surname, postal address, telephone number, email address, National Population Registry Code (CURP), Federal Taxpayer Registry (RFC), or any other information that allows the identification of the data subject, and only through legal and fair means.

Notice, Processing, and Acceptance or Refusal Clause for Data Transfer: Due to the nature of your relationship with us, we will inform you of how your personal data will be processed and who will be responsible for such processing. We will process your personal data fairly and only for the purposes we have informed you of, purposes authorized by you, or as permitted by applicable law (Art. 16 F. II L.F.P.D.P.P.P.). Choice: We give our customers the option to include or remove their personal data from lists used for advertising or marketing purposes, in accordance with applicable law, specifically regarding offers of various products and services offered by Energías Sustentables Cotell, S.A. de C.V. and those carried out in collaboration with our business partners (Art. 16 F.III L.F.P.D.P.P.P.).

You have the right to know what personal data we hold about you, how we use it, and the conditions of such use by sending an email to: contacto@escotell.com.mx. You also have the right to request the correction of your personal information if it is outdated, inaccurate, or incomplete; to request its deletion from our records or databases when you consider it is not being used in accordance with the principles, duties, and obligations set forth in the applicable regulations; and to object to the use of your personal data for specific purposes (Art. 16 F. IV L.F.P.D.P.P.P.). These rights are known as ARCO rights.
4. Data Quality: We use appropriate technology and well-defined practices among our employees to process your personal data promptly and accurately. We will not retain your personal data longer than necessary, unless required by applicable law.
5. Security and Confidentiality: We will keep your personal data confidential and limit access to the person responsible for personal data, except as permitted by applicable law. We adhere to industry standards and use reasonable administrative, technical, and physical security measures to protect your personal data from unauthorized access, destruction, use, modification, or disclosure. We require the application of industry-standard data security measures from the data controller and any third parties that may be authorized to process your personal data.

Data Communication: If for any extraordinary reason we share your personal data with third parties, it would only be done when necessary to provide you with products or services or as part of the nature of your relationship with us, provided we have informed you of this or you have authorized it, in connection with our efforts to reduce fraud or criminal activity, or as permitted by law.

You may request information from us about the nature of the personal data relating to you that is stored or processed by Energías Sustentables Cotell, S.A. de C.V. If any data is inaccurate or incomplete, you may request its modification (Art. 16 F. IV L.F.P.D.P.P.P.).
8. Accountability: Energías Sustentables Cotell, S.A. de C.V., and specifically Mr. Luis Oscar Colin Téllez, is authorized to process your personal data solely in accordance with these Principles. We provide training and conduct compliance reviews of these Principles. Employees who violate these Principles may be subject to disciplinary action, up to and including termination. Employees are expected to report any violation of these Principles and may do so to their supervisors or to the company's legal department.
9. Enforceability: You may enforce these Principles against Energías Sustentables Cotell, S.A. de C.V. as the data controller, as a third-party beneficiary of these Principles. If you have a complaint regarding our non-compliance with these Principles and have made a good-faith effort to resolve it through our customer service offices without resolution within a reasonable time, you may enforce these Principles before the relevant authorities. If you file a complaint with your local data protection authority and that authority determines that we have breached these Principles, we will comply with the data protection authority's decisions, while reserving the right to challenge or appeal such decisions. These Principles do not affect any rights you may have under applicable law, the requirements of any competent data protection regulatory authority, or any other agreement you may have with us.

This privacy notice may be subject to modifications, changes, or updates arising from new legal requirements, our own needs regarding the products or services we offer, our privacy practices, changes in our business model, or other reasons.
We are committed to keeping you informed of any changes to this privacy notice through our offices or by sending the information to the email or physical address you have provided, if you request it (Art. 16 F. VI L.F.P.D.P.P.P.).
In this regard, your registration on the exclusion list must be completed so that your personal data is not processed for marketing, advertising, or commercial prospecting purposes by us. These Principles reinforce our commitment to protecting your personal data. These Principles are binding on Energías Sustentables Cotell, S.A. de C.V., demonstrating our commitment to privacy.
